Version 1
This explicit consent is optional. DocuLiq works without it. It is separate from the Terms of Use, from the Privacy Notice and from the AI data sharing permission you give with the button on the first screen after you sign in, and you can withdraw it at any time in Profile > Legal.
What it covers: The law gives special protection to some kinds of personal data: data about health, criminal convictions and security measures, race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, appearance and dress, membership of associations, foundations or trade unions, sexual life, and biometric and genetic data. With this explicit consent you consent to DocuLiq processing your own data of these kinds in the documents and audio recordings you upload, at every step: storing them, text recognition (Google Cloud Vision), audio transcription (Google Speech-to-Text) and the AI features — summary, risk review, extracted information, chat, translation and the AI step of reminder suggestions (Google's Gemini models on Vertex AI). DocuLiq does this in order to provide the service to you. The Privacy Notice explains where each step takes place.
Who gives it, and when: You give this explicit consent yourself, for your own data, with the explicit consent switch. The switch is on the first screen the app shows after you sign in, above its button, and in Profile > Legal. It is off unless you have turned it on; turning it on is your consent. On the first screen your choice is sent when you tap the button to continue. The button works the same whether the switch is on or off, and if you leave the switch off, nothing is recorded. If your choice cannot be recorded, the app tells you; the consent then counts as not given until you turn the switch on in Profile > Legal. In Profile > Legal a change takes effect at once. The app does not ask again before an upload. The consent applies to your account, not to a single document, and also to the tools that do not add a document to a workspace (such as text recognition, transcription and translation in Tools, or a temporary document in chat). While the switch is off, the consent counts as not given. The consent counts only for the version of this text in effect; when a new version takes effect, the switch goes back to off and the consent must be given again. A new version only stops the AI features; a consent you gave and have not withdrawn still covers keeping your documents.
While the switch is on: DocuLiq stores and processes the documents you upload that contain such data like your other documents, including with the AI features. The results are stored with the document and deleted with it.
While the switch is off: Please do not upload documents that contain such data, and do not use the tools on them. Nothing else in the app changes. If you upload one anyway, DocuLiq cannot know this beforehand: the document is stored and its text is extracted like any other document. Once DocuLiq recognises it as a health or criminal-record document, AI features stay off for that document and it may not be kept without your explicit consent: at the next daily check we email you, the app shows the date on which the document will be deleted, and 7 days after that notice, in the daily clean-up that follows, the document is permanently deleted. Until that date you can download it, export it or delete it yourself; if you turn the switch on, it is not deleted.
Limits of the automatic check: The check reads the extracted text, after the document has been stored and its text recognised or transcribed. It does not use AI. It recognises only health and criminal-record documents, only in the document languages DocuLiq supports, and it can miss a document. It does not recognise the other special categories: even without your consent, such a document is treated like any other document, including by the AI features. Not uploading such documents while the switch is off is therefore your responsibility.
Team workspaces: The switch of the member who uploaded the document counts, even when another member runs an AI feature on it. If the uploader has the switch off, or has deleted their account, AI features stay off for a recognised document for every member and the document is deleted after the period described above; the notice also goes to the workspace owner and admins. For text that is not a stored document — a temporary document, or text typed in for translation — the switch of the person using the feature counts.
Reminder emails: For a recognised document whose uploader has the switch off, a reminder email names neither the document nor the reminder. It only says that a reminder is due, on which date and in which workspace.
Withdrawing: You can withdraw this consent at any time by turning the switch off in Profile > Legal. From that moment AI features stop for the recognised documents you uploaded. Withdrawal does not affect processing that took place before it. The recognised documents you uploaded may no longer be kept: at the next daily check we email you, the app shows the deletion date, and 7 days after that notice, in the daily clean-up that follows, those documents are permanently deleted together with the results already produced. Until that date you can download or export them; if you turn the switch on again, they are not deleted. Your documents that were not recognised remain stored until you delete them: if they contain special-category data, delete them yourself (delete the document, then delete it permanently from the Bin; in a team workspace, ask the workspace owner).
Record: We keep a record each time you give or withdraw this consent: which of the two, when, on which screen, and which version and language of this text was in effect. A switch you leave off on the first screen is not recorded. If you delete your account, these records are held for 5 more years (Privacy Notice, section 7).

The switch is your explicit consent for your own data only. It is not a consent given on behalf of other people.
If you use DocuLiq privately and the documents or audio recordings you upload contain special-category data about another person, DocuLiq processes that data on the basis of that person's own explicit consent, which they give through you, or on the basis that you are their legal representative. By turning the switch on you declare that the person has given their explicit consent to the processing this text describes, or that you are their legal representative. Without it, do not upload such documents.
If you act in a professional or commercial capacity, for example as their lawyer or accountant, you are the controller of that data and decide on its legal ground; turn the switch on only if you are legally entitled to process it. By turning it on you then instruct DocuLiq to process that data on your behalf under the Terms of Use (sections 4 and 11). In a team workspace you give this instruction on behalf of the workspace owner, who authorises each member to give it. While the switch is off, do not upload such documents.
